2014 League Webinar Series continues

The 2014 League Webinar Series resumes this month with a webinar on Council Meeting Decorum and Procedures, which will be held April 17at6 p.m. Attendees will learn how council meeting rules and procedures can lead to a more efficient and effective process as well as some best practices for improving your council meetings. Next month, the series will feature City Regulation of ATVs and Golf Carts on May 15at6 p.m. This webinar will review the state laws regulating ATVs and golf carts and how your city can adopt local ordinances that address traffic and safety concerns.

More information about these and other webinars in the series along with online registration can be found at www.iowaleague.org. Each webinar is recorded and archived, so if you are unable to catch the live version, you can still get access and watch the webinars on your schedule.

Budget amendment

During the budget preparation period the council, staff and other interested parties may see that modifications to the budget might be needed due to circumstances that were not predictable in early 2014 when the current budget was prepared. This year in particular, with the numerous water main breaks and harsh road conditions, many communities will be required to amend their budget.

The budget amendment process is triggered when any expenditure may exceed the amount that was published in any category of the original budget or any subsequent budget amendment. For example, the public works budget may be about to go over the published amount due to the amount of manpower, salt and pothole patching that was needed to combat the 2014 winter. The amendment should be done BEFORE that total is reached.

To do an amendment, it is very similar to doing a budget. The Department of Management has forms that must be used for the amendment. The changes to the budget must be included in the publication for a public hearing. The public hearing notice must be published (or posted if your city is less than 200 in population) no less than 10 days before the hearing, but no more than 20 days before the hearing. After the hearing the council must approve the amendment and have it filed with the county auditor.

Two deadlines must be considered when planning the timing of the amendment: 1) it should be done BEFORE any expenditure category is exceeded and 2) no later than May 31. The May 31 deadline is in the statute to allow citizens to appeal the amendment before the end of the fiscal year which isjune 30.

If other events crop up after an amendment is done which would again exceed any individual category limits, another amendment may be required, but it should be before the May 31 deadline.

City Clerks Week, May 4-10

This year is the 46th Annual Municipal Clerks Week. The International Institute of Municipal Clerks (IIMC) Web site, iimc.com, has a number of activities that communities can use to celebrate Municipal Clerk's Week, May 4-10, 2014.

Code of Iowa Section 380.7 requires every city council to appoint a city clerk (a different title may be used) to do essential duties for the community. The duties of the city clerk will vary based upon the size of community, the number and type of utilities and other city services provided to the citizens. A city clerk acts as a liaison between the public and their government, promotes access to local government, provides access to city records and records the actions of the council to ensure transparency to the public. A city clerk in most communities is also the compliance officer for federal, state and local laws.

Municipal Clerks Week acknowledges that city clerks handle a wide range of city business and often work long hours to ensure their local government runs smoothly. It is crucial for mayors and council members to recruit, identify, train and keep a well-qualified and able person for this position. Doing so can be a longterm investment in the city.
